Every year thousands of people undergo surgery which is performed to save or improve their lives, unfortunately some will either die or sustain injury because of mistakes made by the surgeon. Such an unfortunate event may be grounds for a medical malpractice lawsuit, due to procedural errors lawsuit.
Most patients have faith in the ability and competence of the surgeon and surgical team performing the operation and do not even consider they may fall victim to human error. All it takes sometimes is one slight omission, and the patient may be left in pain, scarred, requiring additional surgery, or in the worst case, death will result.
There are many possible procedural errors which may be made during surgery, some the more common mistakes are as follows. Performing the wrong procedure or operating on the wrong part of the body, possibly even removing a healthy organ. Leaving surgical tools or materials inside the patient’s body, or simply not carrying out the procedure in the correct manner.
Failure to properly sanitize all instruments and the operating surfaces may also cause complications in the form of infection, which can greatly lengthen one’s recovery time and potentially be life-threatening. If proper post-operative care is not provided, this too may constitute a procedural error. Such careless mistakes can lead to organ or nerve damage, paralysis, coma, brain damage, blood clots or even death.
Many of these errors are caused by sloppy handling of patient records and poor communications between members of the healthcare team. Other times it may be bad judgment, lack of experience or skills, stress or sleep deprivation that cause the physician to err.
When someone suspects he or she or a family member may be a victim of negligence, they should consult an attorney immediately. This will not bring back the loved one or reverse any damage that has been done, but it can result in compensation for medical expenses and suffering, and also ensure accountability on the part of the responsible party.
