In a products liability case, a manufacturer is expected to exercise a certain standard of care to ensure the product is safe for the intended use and is free from defects. Manufacturers may also be liable if they misrepresent the product by, for instance, making false claims about its safety. An express or implied warranty regarding a product’s quality and “fitness” for a specific purpose may also be used against the manufacturer, if it was a misrepresentation.
The types of injuries caused by defective products may include electrocution, chemical or thermal burns, blindness, amputation, traumatic brain injury, paralysis, poisoning, and wrongful death. Among the most tragic are those in which babies and young children are harmed by faulty cribs, carriages or playpens, or because of lead paint or choking hazards in toys. Often, defective products are linked to construction site accidents and accidents that occur in amusement parks, among others.
